Juul Labs, Inc. Mobile Messaging Terms and Conditions
Effective Date: May 22, 2026
JUUL Labs, Inc. ("Juul Labs", "we", "us", or "our") offers a mobile messaging program (the "Program"), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions (these "Mobile Messaging Terms"), the Juul Labs General Terms & Conditions, and our Privacy Notice, each of which is incorporated herein by reference. By opting into or otherwise participating in the Program, you accept and agree to these Mobile Messaging Terms. Capitalized terms not otherwise defined herein shall have the meanings described in the Juul Labs General Terms and Conditions of Privacy Notice, respectively.
1. Program Description
If you are an adult individual (21 years of age or older) and have completed Juul Labs’ account creation and securing process, as well as Juul Labs’ age, identity and phone number verification and Program opt-in, the Program enables you to receive recurring mobile messages from Juul Labs, as well as periodic messages based on your interactions and relationship with us, including, without limitation, transactional messages related to your account such as order status updates, customer service communications, product safety notices, and informational and promotional messages regarding JUUL products and Services.
The Program is a mobile messaging program that delivers both transactional and promotional messages from Juul Labs, including, without limitation, account creation confirmations, account verifications, order confirmations, payment confirmations, shipping and delivery updates, account alerts, customer service responses, warranty communications, product safety notices, security messages, and marketing and promotional messages regarding JUUL products, offers, and Juul Labs' commercial activities. Receipt of mobile messages under the Program requires your prior express written consent through a single affirmative opt-in as described in Section 2. Promotional messages are delivered via Short Message Service (“SMS”) and Multimedia Messaging Service (“MMS”) (collectively, “mobile messages”) and require a mobile device and wireless carrier service capable of receiving MMS messages, as further described in Section 8.
Notwithstanding the foregoing, by providing your mobile telephone number to Juul Labs for the express purpose of creating and securing your account and completing age, identity and phone number verification, you give your prior express consent under the Telephone Consumer Protection Act, 47 U.S.C. § 227, and similar federal and state laws to receive one-time passcode ("OTP") text messages from Juul Labs at the mobile telephone number provided for those purposes, including, without limitation, OTPs sent during JUUL.com account creation, password resets, login verification from new or unrecognized devices, account recovery, and other account-security and age, identity and phone number verification events. OTPs sent for these purposes are the only mobile messages Juul Labs will send to your mobile telephone number unless you complete the affirmative opt-in described in Section 2. Standard message and data rates may apply to OTP messages.
The following disclosure summarizes the key terms of the Program and is provided in connection with the carrier registration of the Program:
Juul Labs Mobile Messages on short code 536808. Recurring Messages. Message and Data Rates May Apply. When you complete forms online or otherwise provide us information in connection with the Program, you agree to provide accurate, complete and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If we, in our sole discretion, believe that any such information is untrue, inaccurate or incomplete, we may refuse you access to the service and pursue any appropriate legal remedies. When you opt-in to the service, JUUL Labs Inc. will send you a message to confirm your signup. Text HELP to 536808 for info or email us at SMShelp@juul.com. Text STOP to 536808 to stop. After you send the message "STOP" we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive messages from us. If you want to join again, opt in to mobile messaging on your JUUL.com account at juul.com/account/profile and we will start sending messages to you again. Carriers are not liable for delayed or undelivered messages.
2. User Opt-In and Express Written Consent
By completing the opt-in described in these Mobile Messaging Terms, you provide your prior express written consent to receive automated transactional and promotional mobile messages from Juul Labs at the mobile telephone number associated with your opt-in (including, without limitation, the categories of messages described in Section 1). You understand that your consent to receive promotional messages from Juul Labs is not required to make any purchase from Juul Labs. While you consent to receive messages sent using an automated system, the foregoing shall not be interpreted to suggest or imply that any or all of Juul Labs’ mobile messages are sent using an automatic telephone dialing system. Message and data rates may apply. By providing Juul Labs with a mobile telephone number and completing the opt-in described in these Mobile Messaging Terms, you represent that (i) you are a tobacco or nicotine consumer who is 21 years of age or older; (ii) you are the subscriber for or the customary, authorized user of the mobile telephone number you have provided; (iii) you are authorized to consent to the receipt of mobile messages at that number; and (iv) you acknowledge that messaging and data rates may apply and are authorized to approve any related charges for messaging and data applied by your wireless carrier. Please note that Voice Over Internet Protocol numbers are not eligible and may be removed from the Program at our discretion upon discovery.
Promotional messages will always include messages sent via MMS and require a mobile device and wireless carrier service capable of receiving MMS messages. This requirement is further detailed in Section 8.
Regardless of the opt-in method you used to join the Program, you agree that these Mobile Messaging Terms apply to your receipt of all mobile messages from Juul Labs and your participation in the Program.
3. User Opt-Out
If you do not wish to continue participating in the Program or no longer agree to these Mobile Messaging Terms, you may opt-out at any time by replying "STOP", "QUIT", "END", “REVOKE”, “OPT OUT”, “OPTOUT”, “OPT-OUT”, “STOPALL”, "CANCEL", or "UNSUBSCRIBE" to any mobile message you receive from Juul Labs. These keywords are not case sensitive. After you send any such message, Juul Labs will send a reply confirming that you have been unsubscribed, and you will no longer receive mobile messages from the Program. The opt-out keywords above will unsubscribe you from all Juul Labs mobile messages.
If you want to rejoin the Program, you may opt-in again by affirmatively agreeing to do so when engaging with our Services or by logging into your JUUL.com account at www.juul.com/account/profile and updating your communications preferences, and Juul Labs will resume sending messages to you. If you are subscribed to multiple mobile messaging programs administered by Juul Labs, Juul Labs will either (1) unsubscribe you from all such programs or (2) respond with additional mobile messages to allow you to clarify whether you wish to be unsubscribed from a particular program or from all mobile messaging programs administered by Juul Labs.
While replying with one of the opt-out keywords above is the preferred method to revoke your consent, you may also (a) manage your Program subscription by logging into your JUUL.com account at www.juul.com/account/profile and updating your communications preferences, or (b) opt-out of the Program by contacting Juul Labs Customer Support at www.juul.com/support, emailing Juul Labs at SMShelp@juul.com, or calling Juul Labs at 1-855-509-5885. Opt-outs submitted through Customer Support are effective after they are confirmed, not when they are received. Opt-outs submitted through the Profile section of your JUUL.com account are processed automatically and take effect immediately. After you opt-out, Juul Labs will retain a record of your mobile telephone number on its internal suppression list as necessary to honor your opt-out and to comply with applicable law.
4. Duty to Notify and Indemnify
If at any time you intend to stop using the mobile telephone number you used to subscribe to the Program, including by canceling your service plan or selling, transferring, or porting the phone number to another party, you agree that you will complete the User Opt-Out process set forth above prior to ending your use of that mobile telephone number. You understand and agree that your agreement to do so is a material part of these Mobile Messaging Terms. You further agree that, if you discontinue the use of your mobile telephone number without notifying Juul Labs of such change, you will be responsible for all costs (including reasonable attorneys’ fees) and liabilities incurred by Juul Labs, or any party that assists Juul Labs in the delivery of mobile messages, as a result of claims brought by the individual(s) who is later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your participation in the Program.
YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD HARMLESS JUUL LABS, ITS AGENTS, AND ANY THIRD-PARTY SERVICE PROVIDER ENGAGED BY JUUL LABS TO SEND MOBILE MESSAGES UNDER THE PROGRAM (INCLUDING, WITHOUT LIMITATION, JUUL LABS’ MOBILE MESSAGING PLATFORM PROVIDER) FROM AND AGAINST ANY CLAIM, ACTION, OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY JUUL LABS OF A CHANGE IN OR INACCURACY OF THE INFORMATION YOU HAVE PROVIDED, OR ANY BREACH OF YOUR REPRESENTATIONS HEREIN, INCLUDING, BUT NOT LIMITED TO, ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, ET SEQ., OR SIMILAR FEDERAL OR STATE LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER, ARISING FROM JUUL LABS ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.
5. Cost and Frequency
Message and data rates may apply. The Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with Juul Labs. Message frequency varies. You are solely responsible for any costs charged by your wireless carrier in connection with messages received under the Program, including data charges.
6. Support
For support regarding the Program, text "HELP" to the short code from which you received Program messages, email Juul Labs at SMShelp@juul.com, or contact Juul Labs Customer Support at www.juul.com/support. Please note that the use of the support email address or Customer Support is not a substitute for the User Opt-Out procedures set forth in Section 3 above. Opt-outs must be submitted in accordance with those procedures.
7. No Sale or Sharing of Mobile Information
Juul Labs will not sell or share your mobile telephone number or mobile information with any third party for those parties' own promotional or marketing purposes. Juul Labs may share mobile information with subcontractors and service providers who assist Juul Labs in operating the Program (such as Juul Labs' mobile messaging platform provider) solely to deliver the Program.
8. MMS Capability Required for Promotional Messages
MMS capability is required to receive promotional messages. If your mobile device or wireless carrier service does not support MMS, you will not be able to receive promotional messages, and Juul Labs may, in its sole discretion, decline to deliver or cease delivering promotional messages to your mobile telephone number. Transactional messages may be delivered as SMS or MMS, and Juul Labs may deliver SMS terminating messages in lieu of MMS for transactional messages where appropriate. Some mobile devices and wireless carriers may not support all message formats, and message content may appear differently on different devices.
9. Disclaimer of Warranty; Carrier Disclaimer
THE PROGRAM IS OFFERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS AND MAY NOT BE AVAILABLE IN ALL AREAS AT ALL TIMES, AND MAY NOT CONTINUE TO WORK IN THE EVENT OF PRODUCT, SOFTWARE, COVERAGE, OR OTHER CHANGES MADE BY YOUR WIRELESS CARRIER. JUUL LABS WILL NOT BE LIABLE FOR ANY DELAYS OR FAILURES IN THE RECEIPT OF ANY MOBILE MESSAGES CONNECTED WITH THE PROGRAM. DELIVERY OF MOBILE MESSAGES IS SUBJECT TO EFFECTIVE TRANSMISSION FROM YOUR WIRELESS SERVICE PROVIDER OR NETWORK OPERATOR AND IS OUTSIDE OF JUUL LABS’ CONTROL. CARRIERS ARE NOT LIABLE FOR DELAYED OR UNDELIVERED MESSAGES.
10. Adult Tobacco or Nicotine Consumers Only (21+)
In order to subscribe to the Program, you must be 21 years of age or older and have certified that you are a tobacco or nicotine consumer who is 21 years of age or older, that you wish to receive information and promotions concerning JUUL products, and that you understand that providing false information may constitute a violation of law. Before you are eligible to be added to the Program, Juul Labs will verify that you are 21 years of age or older through Juul Labs’ age, identity, and phone number verification. If you are under 21 years of age or have otherwise gained access to the Program by providing false information (including, without limitation, a false date of birth), you must unsubscribe from the Program immediately. If Juul Labs becomes aware that an individual under 21 years of age has accessed the Program, Juul Labs will terminate that individual's participation in the Program, and terminate any associated JUUL.com account.
11. Truthful and Accurate Information
When you complete forms online or otherwise provide information to Juul Labs in connection with the Program, you agree to provide accurate, complete, and truthful information. You agree not to use a false or misleading name or a name that you are not authorized to use, and not to provide a mobile telephone number that you are not the subscriber or customary user of. If, in Juul Labs’ sole discretion, Juul Labs believes that any such information is untrue, inaccurate, incomplete, or that you have opted into the Program for an ulterior purpose, Juul Labs may refuse you access to the Program, terminate your participation, and pursue any appropriate legal remedies.
12. Privacy
Personal data Juul Labs collects in connection with your participation in the Program is processed in accordance with Juul Labs' Privacy Notice, available at www.juul.com/privacy/privacy-notice.
13. Consent to Receipt of Electronic Information and E-SIGN
Notwithstanding anything to the contrary, you understand that applicable law may require Juul Labs to provide certain information to you in writing in connection with any consent to receive advertising and telemarketing telephone calls and mobile messages. By completing the affirmative opt-in described in Section 2, you authorize Juul Labs to provide this information to you electronically rather than in a separate paper document. You may withdraw this consent, update your information, or request a free paper copy of the information by contacting Juul Labs Customer Support at www.juul.com/support. You understand that to access and retain a copy of these Mobile Messaging Terms, you will need: (i) a device (such as a computer or mobile phone) with a web browser and Internet access; and (ii) available storage space on that device, or a connected printer, to download or print a copy of these Mobile Messaging Terms.
14. Modification of These Terms
Juul Labs reserves the right to revise these Mobile Messaging Terms from time to time. If Juul Labs revises these Mobile Messaging Terms, the revised Mobile Messaging Terms will supersede prior versions and, unless otherwise stated, will be effective upon the effective date indicated at the top of these Mobile Messaging Terms. Material updates to these Mobile Messaging Terms will be communicated to you by mobile message that includes a link to the updated Mobile Messaging Terms or by other reasonable means. Your continued participation in the Program after notice of an update constitutes your acceptance of the revisions. If you do not agree to the revisions, you must opt-out of the Program in accordance with Section 3.
Juul Labs further reserves the right to suspend, modify, or discontinue the Program, in whole or in part, at any time, with or without notice. Juul Labs will not be liable to you or any third party for any suspension, modification, or discontinuation of the Program.
15. Disputes, Arbitration and Class Action and Jury Trial Waiver
Read this Section carefully because it requires the parties to arbitrate their disputes and limits the way you can seek relief from Juul Labs. THESE TERMS CONTAIN A MANDATORY INDIVIDUAL ARBITRATION AND CLASS ACTION/JURY TRIAL WAIVER PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS. For any dispute with Juul Labs, you agree to first contact our Customer Support and attempt to resolve the dispute with us informally.
Arbitration. In the unlikely event that we are unable to resolve a dispute after sixty (60) days, you and Juul Labs each agree to resolve any claim, dispute, or controversy arising out of or in connection with or relating to these Terms, the breach or alleged breach thereof, or your purchase or use of the Products (collectively, "Claims"), by binding arbitration by JAMS, under the Optional Expedited Arbitration Procedures then in effect for JAMS, except as provided herein (including the exclusion of any claims brought by Juul Labs for injunctive or other equitable relief as provided in Section 17 below).
JAMS may be contacted at www.jamsadr.com. The arbitration will be conducted in Wilmington, Delaware, unless otherwise agreed. If you are using the Products or Services for non-commercial purposes: (i) JAMS may require you to pay a fee unless you obtain a fee waiver; (ii) the award may include your costs of arbitration, reasonable attorney's fees, and reasonable costs for expert and other witnesses; and (iii) you may sue in a small claims court of competent jurisdiction without first engaging in arbitration, but this does not excuse you from the informal dispute resolution process. Any judgment on the award may be entered in any court of competent jurisdiction consistent with Section 16.
Class Action and Jury Trial Waiver. All claims must be brought in the parties' individual capacity, not as a plaintiff or class member in any class action, collective action, private attorney general action, or other representative proceeding. This waiver applies to class arbitration, and the arbitrator may not consolidate more than one person's claims unless Juul Labs agrees.
JURY TRIAL WAIVER. TO THE EXTENT ALLOWED BY LAW, YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND JUUL LABS ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.
Time for Making Claims: TO THE EXTENT ALLOWED BY APPLICABLE LAW, YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OR THE CAUSE OF ACTION IS PERMANENTLY BARRED.
16. Governing Law and Venue
These Terms will be governed by and interpreted under the laws of the State of Delaware, USA, without regard to its principles of conflict of laws. Exclusive venue for any action to determine the enforceability of the arbitration provision in Section 15 or the arbitrability thereunder of any dispute, or to enforce an arbitral award rendered pursuant to these Terms will be the state or federal courts of Wilmington, Delaware. You agree that Wilmington, Delaware is the proper forum for any appeals of an arbitration award or for trial court proceedings if the arbitration provision in Section 15 is found to be unenforceable. You agree not to bring any such actions in any other venue, and you expressly agree to waive all objections to these venues.
You consent to personal and subject matter jurisdiction in Delaware state and federal courts. The Services and Products are deemed solely based in Delaware and are passive services that do not give rise to personal jurisdiction over Juul Labs outside Delaware.
The parties acknowledge that these Terms evidence a transaction involving interstate commerce. Notwithstanding the preceding sentences with respect to the substantive law, any arbitration conducted pursuant to the terms of these Terms shall be governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16). THE APPLICATION OF THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS IS EXPRESSLY EXCLUDED.
We reserve the right to seek injunctive or other equitable relief to prevent infringement or violation of our intellectual property rights.
17. Relationship to Juul Labs General Terms & Conditions
These Mobile Messaging Terms supplement, and do not to replace, the Juul Labs General Terms & Conditions. The eligibility, age verification, account, electronic communications, indemnification, limitation of liability, release, governing law, and arbitration provisions of the Juul Labs General Terms & Conditions remain in full force and effect with respect to your relationship with Juul Labs and apply to your participation in the Program except as expressly modified herein. In the event of any conflict between these Mobile Messaging Terms and the Juul Labs General Terms & Conditions with respect to the Program, these Mobile Messaging Terms shall control as to the Program only.
18. Miscellaneous
You represent and warrant to Juul Labs that you have all necessary rights, power, and authority to agree to these Mobile Messaging Terms and perform your obligations hereunder, and that nothing contained in these Mobile Messaging Terms or in your performance hereunder will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these Mobile Messaging Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Mobile Messaging Terms will otherwise remain in full force and effect and enforceable. These Mobile Messaging Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Juul Labs without restriction. Any new features, changes, updates, or improvements of the Program shall be subject to these Mobile Messaging Terms unless expressly stated otherwise in writing.
